Mississippi Medical Dispensary License

The Mississippi Department of Revenue (MDOR) is now accepting complete applications for Medical Cann

 In January of 2022, the Mississippi legislature passed SB 2095, The Mississippi Marijuana Act, which established licensure for medical cannabis dispensaries, among other cannabis industry businesses. According to MDOR, “The Mississippi Medical Cannabis Act defines the medical cannabis dispensary as an entity licensed and registered with the MDOR that acquires, possesses, stores, transfers, sells supplies, or dispenses medical cannabis, equipment used for medical cannabis, or related supplies and educational materials to cardholders. A dispensary can only be in an area zoned commercial or in an area that is not otherwise prohibited from having commercial businesses.” CannDelta’s regulatory experts can help you start your MS medical marijuana dispensary and ensure all pieces of your application are completed accurately, such as operation plans and security plans.  

MS Dispensary License Fee

 First Year: $40,000

Non-Refundable Application Fee: $15,000

Annual License Fee: $25,000

Yearly Renewal: $25,000

Am I eligible to apply for a Mississippi Dispensary License?

 Eligibility applicants: 

  • Individuals at least twenty-one (21) years of age
  • Any owner, board member, officer, or anyone with an economic interest in the entity must be at least twenty-one (21) years of age
  • Not currently serving as a member of the Mississippi Senate or House of Representatives or spouse of a member of the Mississippi Senate or House of Representatives through December 31, 2022
  • Has not previously held a Cannabis related license that has been revoked
  • Has no outstanding tax liabilities owed to the State of Mississippi
  • Has never been convicted of a disqualifying felony as defined by the Mississippi Medical Cannabis Act
  • Applicants are not required to be residents of the State of Mississippi to obtain a dispensary license

Things To Know For Your Mississippi Medical Cannabis Dispensary License Application

 You can apply for a license online through the Mississippi Medical Cannabis Program Portal which includes the following requirements:

  • Legal Name of Business and Physical Address (No PO Box allowed)
  • Proof of Mississippi Secretary of State Registration, if applicable
  • Mississippi Sales Tax Permit Number
    • NAICS Code for Dispensary is 453998
  • Management Service Agreements, if applicable
  • Deed of Trust, Lease Agreement, or Contingent Agreement, if applicable
  • Land Survey by a Mississippi-licensed surveyor proving that the main entrance of the dispensary is not within 1,000 feet of a school, church, or childcare facility’s nearest property boundary line
    • Waiver of Minimum Distance Requirements (childcare, school, church), if applicable
  • No medical cannabis dispensary may be located within a 1,500 feet radius from the main point of entry of the dispensary to the main point of entry of another medical cannabis dispensary
  • Proof that location meets county or city zoning / sworn statement certifying proposed location is compliant with said restrictions
  • Local business permit or license registration, if required by city or county (if under construction, projected date of issuance of city/county license) OR Statement on Local Privilege Licenses and Permits
  • List of all owners, partners, members, officers, board members and anyone with a 10% or greater economic interest
  • Affidavit for Background Check as well as date that fingerprint cards were sent by applicant(s) to MSDH
  • List of all professional licenses held by each member and proof that each is in good standing
  • Acknowledgment of Waiver and Authorization to Release Information for each member
    • MDOH
    • MDOR
  • Licensee Certification/Oath
  • Diagram of licensed premises
  • Operations plan
  • Security plan

What’s Next After Submitting Your MS Cannabis Dispensary Application?

 All information required by the application must be completed along with the required cannabis dispensary licensing fees in order for MDOR to approve the license. Applicants should expect to receive a determination within 30 days of receiving the completed application. If your application was rejected, to correct your application, log in to the Mississippi Cannabis Program Portal, go to the Applications menu on the left-hand side, and select the application you would like to edit.

You will need to resubmit your application after you have edited it in order for it to be reviewed.
